1. Acceptance of Terms

By downloading, installing, or using Fern ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Fern is a mobile application that allows you to track your menstrual cycle and pregnancy. The App provides features including period logging, cycle predictions, symptom and mood tracking, pregnancy week-by-week tracking, kick counting, appointment scheduling, and data backup.

3. Medical Disclaimer

Specifically:

• Cycle predictions and fertile window calculations are estimates based on your personal data history and standard medical algorithms. They should not be used as the sole method of contraception or conception.
• Pregnancy tracking information, including week-by-week development descriptions, is general educational content and may not reflect your specific pregnancy.
• Symptom and health data logged in the App does not constitute a medical record.
• Always consult with a qualified healthcare provider for medical advice, diagnosis, or treatment.

4. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

5. User Responsibilities

You are responsible for:

• The accuracy of data you enter into the App
• Maintaining the security of your device, passcode, and backup passwords
• Creating regular backups of your data if data preservation is important to you
• Understanding that data stored only on your device will be lost if the device is lost, damaged, or the App is uninstalled (unless you have enabled iCloud sync or created a backup)

6. Subscriptions and In-App Purchases

6.1 Free Features

Fern offers a comprehensive set of free features including period tracking, cycle predictions, pregnancy tracking, and all privacy and security features.

6.2 Premium Features

Fern offers optional premium features available through two purchase options:

• Fern Premium Lifetime: A one-time purchase of $6.99 (USD) that permanently unlocks all premium features.
• Fern Premium Monthly: An auto-renewable subscription of $1.99 (USD) per month.

6.3 Subscription Terms

• Payment is charged to your Apple ID account at confirmation of purchase.
• The monthly subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscription in your Apple ID Account Settings at any time.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

6.4 Refunds

All purchases are processed by Apple. Refund requests must be made through Apple. We do not process refunds directly. Visit reportaproblem.apple.com to request a refund from Apple.

7. Intellectual Property

The App, including its design, code, content, icons, and branding, is owned by Piotr Gebski and is protected by copyright and other intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the Fern name or branding without prior written permission
• Remove or alter any copyright or proprietary notices

8. Your Data

You retain full ownership of all data you enter into the App. We do not claim any rights to your data. Since all data is stored locally on your device (or in your private iCloud account if you enable sync), you have complete control over your information at all times.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
• We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
• Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
• We are not responsible for any health decisions made based on data or predictions provided by the App.

10. Data Loss

Since your data is stored locally on your device, we are not responsible for data loss due to:

• Device loss, theft, or damage
• App uninstallation
• iOS updates or device resets
• Failure to create backups

We strongly recommend enabling iCloud sync or creating regular encrypted backups to protect your data.

11. Termination

You may stop using the App at any time by uninstalling it. We reserve the right to modify or discontinue the App at any time. If we discontinue the App, we will provide reasonable notice when possible.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

14. Apple's Standard EULA

In addition to these Terms, your use of the App is governed by Apple's Standard End User License Agreement (EULA) available at apple.com/legal/internet-services/itunes/dev/stdeula.
