Please read these Terms of Use ("Terms") carefully before using Numvana ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using Numvana, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Numvana ("we", "us", or "our").
2. Description of Service
Numvana is a free puzzle game for iOS that features:
- A hexagonal grid-based number-merging puzzle
- Four game modes: Zen (endless), Challenge (competitive), Daily Challenge (one puzzle per day), and Focus Timer (Pomodoro productivity)
- Game Center leaderboards for all game modes and difficulties
- Unlockable visual themes earned through gameplay achievements
- Optional in-app purchases for premium themes, ad removal, and bundles
- Local data storage for game progress, scores, and preferences
The App is provided free of charge. Revenue is generated through non-intrusive advertisements and optional in-app purchases.
3. Eligibility
Numvana is rated 4+ and is available to users of all ages. No account or registration is required to use the App. If you are under the age of 13, you should review these Terms with a parent or guardian.
4. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any iOS device that you own or control, solely for personal, non-commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions.
5. Restrictions
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or disassemble the App
- Attempt to extract the source code of the App
- Remove, alter, or obscure any proprietary notices in the App
- Use the App for any unlawful purpose
- Use automated systems or scripts to interact with the App
- Attempt to interfere with or disrupt the App's functionality
6. Intellectual Property
All content in Numvana — including but not limited to the game design, graphics, animations, audio, tile names, color themes, and code — is owned by us and protected by copyright and other intellectual property laws.
The nature-inspired tile names (Morning Mist, Silver Rain, Spring Water, Clear Sky, Forest Moss, Ocean Glass, Honey Light, Sunset Coral, Autumn Berry, Twilight, Golden Dawn, Cherry Blossom) and the Numvana name are our intellectual property.
7. Advertisements
The App displays advertisements provided by Google AdMob. These ads are subject to the following limits:
- Interstitial ads are shown between game sessions, not during gameplay
- Ads are rate-limited to a maximum frequency and daily cap
- Your first sessions with the App are ad-free
- The "Enlightened" achievement (reached through gameplay) removes interstitial ads permanently
- Ad removal is also available as an in-app purchase through the Store
By using the App, you consent to the display of advertisements. Ad content is provided by third parties and we are not responsible for the content of third-party advertisements.
8. In-App Purchases
Numvana offers optional in-app purchases including:
- Premium visual themes (Aurora, Volcano, Sakura)
- Theme Collection bundle (all premium themes at a discount)
- Starter Bundle (ad removal + theme + power-ups, available for the first 7 days)
- Ad Removal (permanently removes interstitial ads)
All in-app purchases are non-consumable and processed through the App Store. No subscription fees are charged. Core gameplay features (all four game modes, leaderboards, and gameplay-unlockable themes) remain free. You can restore purchases at any time through the Store screen in the app.
9. Data and Privacy
Your privacy is important to us. Our Privacy Policy explains how information is collected and used when you use the App. By using Numvana, you agree to the collection and use of information as described in the Privacy Policy.
All game data (scores, settings, achievements, game state) is stored locally on your device and is not transmitted to any server.
10. Notifications
The App may request your permission to send local push notifications for daily reminders and Focus Timer alerts. These notifications are generated on your device. You may disable notifications at any time through the App's settings or iOS system settings.
11. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will be uninterrupted, timely, secure, or error-free
- The results obtained from using the App will be accurate or reliable
- Any errors in the App will be corrected
12. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the App
- Any unauthorized access to or use of your device
- Any interruption or cessation of the App
- Any content or conduct of any third party in connection with the App
13. Indemnification
You agree to indemnify, defend, and hold harmless Numvana and its developers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your use of the App or violation of these Terms.
14. Focus Timer Disclaimer
The built-in Focus Timer is a productivity tool provided for convenience. It is not intended as a medical device or treatment for attention disorders. We make no claims about productivity improvements or health benefits. Timer accuracy depends on your device and may vary when the App is in the background.
15. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
You may terminate your use of the App at any time by deleting it from your device. Upon deletion, all locally stored data will be removed.
16. Changes to These Terms
We may update these Terms from time to time. Any changes will be reflected in the "Last updated" date at the top of this document. Your continued use of the App after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
17. Apple-Specific Terms
These Terms are between you and Numvana, not Apple Inc. ("Apple"). Numvana, not Apple, is solely responsible for the App and its content. Your use of the App must comply with the Apple Media Services Terms and Conditions.
Apple has no obligation to furnish any maintenance or support services with respect to the App. Apple is not responsible for addressing any claims relating to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. Apple has no other warranty obligation with respect to the App.
Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes that third party's intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
